Terms of Use

Please read these Terms of Use (the "Terms") carefully as they are the terms and conditions that apply to anyone who visits Fred's Platform or uses Fred's services, regardless of whether such User becomes a Purchaser ("you", "User" or "Users"). By using the Services provided by Fred's Teaser Picks, LLC ("Fred's", "we", or "us") or by visiting any Platform where the Services are offered, you agree to be bound by these Terms of Use.

1. Operator

The Services are provided by Fred's Teaser Picks, LLC, with an address of 8 The Green #26576, Dover, DE 19901.

2. Purpose and Nature of the Services

Fred's provides sports-related informational services, products, and content, which may include, without limitation, statistical data, editorial content, sports commentary, game predictions, analysis tools, subscription-based picks, newsletters, emails, website content, mobile application content, and other sports-related information (the "Services") which may be distributed through Fred's websites, mobile applications, email communications, social media, or other distribution channels (collectively, "Platforms"). All data, commentary, predictions, picks, and other information included as part of the Services are produced for entertainment and informational purposes only.

3. Non-conforming Use

You acknowledge that sports wagering is a heavily regulated activity with varying requirements depending on the user's jurisdiction, and you agree to use the Services at your own risk. You shall not use the Services in any manner that directly or indirectly violates any local, state, federal or international laws, or otherwise violates these Terms ("Non-conforming use"). Non-conforming use of the Services is hereby strictly prohibited, and Fred's is not responsible for damages to users or any third parties as a result of any non-conforming use.

Fred's expressly disclaims having any sort of insider knowledge, confidential information, proprietary information, protected information, or other nonpublic information of any kind. The Services are based solely on Fred's independent observations and analysis as an outside observer. The Services merely offer information and commentary about sports, and in no way does Fred's participate in wagering of any kind. Fred's does not accept wagers, transmit wagers, or hold itself out as a licensed gaming operator.

YOU SHALL NOT USE THE SERVICES IN ANY MANNER INCONSISTENT WITH THESE TERMS, INCLUDING BUT NOT LIMITED TO USING THE SERVICES TO PLACE BETS ON ILLEGAL OR UNREGULATED SPORTS BETTING PLATFORMS.

4. Availability

There will be occasions when the Services will be interrupted for maintenance, upgrades and/or emergency repairs or due to failure of telecommunications links and equipment that are beyond our control. You agree that Fred's shall not be liable to you for any modification, limitation, suspension or discontinuance of the Services. Additionally, we reserve the right to modify or terminate the Services for any reason and without notice.

You are responsible for obtaining access to the Services, and such access may necessitate third party fees such as internet provider or airtime charges. You are responsible for those fees, including any related fees associated with the display or delivery of advertisements.

5. Privacy

Fred's has a firm commitment to safeguarding your privacy. The terms of our Privacy Policy are incorporated into, and considered part of, these Terms.

6. Copyright

Fred's is, unless otherwise stated, the owner of all copyright and database rights in the Services and its contents. You may not reproduce, duplicate, copy, sell, trade, store, create derivative works of, or exploit for commercial purposes the Services, access to the Services, or any contents of the Services without our express written consent.

USER AGREES NOT TO REPRODUCE, REPUBLISH, UPLOAD, POST, TRANSMIT, DISTRIBUTE, COPY, PUBLICLY DISPLAY, OR OTHERWISE USE ANY FRED'S PRODUCT OR CONTENT, OR ANY DERIVATIVE WORKS THEREOF, IN WHOLE OR IN PART, AND AGREES NOT TO ASSIST ANYONE ELSE IN DOING THE SAME, WITHOUT FRED'S ADVANCE WRITTEN APPROVAL. VIOLATION OF THIS PROVISION MAY RESULT IN IMMEDIATE TERMINATION OF YOUR ACCESS TO THE SERVICES.

In addition, User agrees not to access the Services by any means other than through the websites, mobile applications, email communications, and other means of information distribution (collectively, the "Platforms") which are provided by Fred's for use in accessing the Services.

Notwithstanding the above, Users may post or share a link to Fred's homepage (www.fredsteaserpicks.com), provided it is fair and legal and does not damage Fred's reputation. Users may not post a link to suggest any form of association, approval, or endorsement by Fred's without Fred's express written consent. Fred's reserves the right to deny users the right to use or share links to Fred's website at any time and for any reason. All links to the website must be to Fred's home page. "Deep Linking" to internal pages of Fred's website is expressly prohibited.

7. Trademarks

All brand, product, and service names, images, and marks used in connection with the Services which identify Fred's, professional or collegiate sports teams, or other third parties and their products and Services are proprietary marks of Fred's and/or the relevant third parties. Fred's is not affiliated with, endorsed by, or sponsored by the National Football League, any sports team, or any sportsbook. Fred's uses the term "NFL" solely as a reference to identify particular football games and teams. Nothing in these Terms or in the Services shall be deemed to confer on any person any license or right on the part of Fred's or any third party with respect to any such brand, product, and service names, images, and marks.

In the specific case of professional, collegiate, or amateur team and/or league logo images and marks, Fred's uses such images and marks for demonstration purposes only.

8. Reporting Violations of Your Copyrights

If you believe any copyright in your work has been violated through the Services, please contact our agent for notice of claims of copyright infringement at fred@fredsteaserpicks.com. You must provide our agent with the following information, which Fred's may then forward to the alleged infringer:

  1. Identify the material on the Services that you believe infringes your work, with enough detail so that we may locate it on the Services;
  2. Provide your address, telephone number, and email address;
  3. Provide a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
  4. Provide a statement that (i) the information you have provided to us is accurate, and (ii) you are the owner of the copyright interest involved, or you are authorized to act on behalf of that owner; and
  5. Provide your physical or electronic signature. Upon receiving your complaint, Fred's may remove content that you believe infringes your copyright.

9. Amendment of the Terms

Fred's reserves the right to amend these Terms from time to time without any notice to you. Your continued use of the Services constitutes acceptance of the new terms. Unless explicitly stated otherwise, any future enhancements or changes to the Services shall be automatically subject to these Terms. Notwithstanding the foregoing, no amendment to the dispute resolution provisions set forth in Sections 24 through 31 of these Terms (Governing Law; FAA, Agreement to Arbitrate, Location; Hearing Format, Class Action Waiver, Delegation, Arbitration Fees and Costs, Remedies; Limitation of Liability, and Jury Trial Waiver) will be effective as to you until Fred's has posted notice of the amendment on the Platforms specifying a definite effective date that is at least thirty (30) days after the date the notice is posted. Your continued use of the Services on or after that effective date constitutes your acceptance of the amended dispute resolution provisions. Any Dispute that arose, or the facts underlying which arose, before the specified effective date will continue to be governed by the dispute resolution provisions in effect at the time the Dispute arose.

10. Advertisements

You understand and agree that the Services may include advertisements and that these advertisements are necessary for us to provide the Services. Your correspondence or business dealings with, or participation in promotions of, advertisers found on or throughout the Services, including payment and delivery of related goods or Services, and any other terms, conditions, warranties or representations associated with such dealings, are solely between you and these advertisers. You agree that we shall not be responsible or liable for any kind of loss or damage incurred as a result of any such dealings or as the result of the presence of such advertisers on the Services.

11. Links

The Services may contain links to other Internet sites or software applications (collectively, "Referral Destinations"). You acknowledge that Fred's is not responsible or liable for any content, advertising, products, or other materials on or available from Referral Destinations. You further agree that Fred's shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any content, goods or Services available on or through Referral Destinations.

Payments are processed through Whop, a third-party payment processor that is not affiliated with Fred's. By purchasing the Services, you authorize Fred's to use Whop to process your payment. You also acknowledge and agree that Whop may calculate, collect, and remit applicable sales taxes, which may increase the total amount charged above the listed price for the Services. By using Fred's Services, you certify that you have read, understood, and agree to be bound by both Whop's Terms of Use and Privacy Policy.

12. Disclaimer of Warranty and Limitation of Liability

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

  1. YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. YOU UNDERSTAND THE RISKS ASSOCIATED WITH SPORTS WAGERING AND YOU AGREE THAT YOUR USE OF THE SERVICES CONSTITUTES A VOLUNTARILY AND KNOWING ACCEPTANCE OF THOSE RISKS. PAST RESULTS DO NOT GUARANTEE FUTURE SUCCESS. IN NO WAY DO THE SERVICES GUARANTEE PROFITABILITY.
  2. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITH NO REPRESENTATIONS OR WARRANTIES AS TO THE ACCURACY, VALUE, PERFORMANCE CAPABILITY, OR RELIABILITY OF THE SERVICES OR INFORMATION CONTAINED IN THE SERVICES. FRED'S EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
  3. FRED'S DOES NOT RECOMMEND, ENDORSE, REVIEW, RANK, OR DIRECT USERS TO ANY PARTICULAR SPORTSBOOK, BETTING WEBSITE, BETTING APPLICATION, BETTING LOCATION, OR WAGERING PLATFORM. ANY DECISION BY YOU TO USE ANY SPORTSBOOK, BETTING WEBSITE, BETTING APPLICATION, BETTING LOCATION, OR WAGERING PLATFORM IS MADE SOLELY BY YOU AT YOUR OWN RISK AND RESPONSIBILITY.
  4. FRED'S MAKES NO PROMISE, REPRESENTATION, OR WARRANTY THAT (i) THE SERVICES WILL MEET YOUR REQUIREMENTS, (ii) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE, (iii) THE SERVICES WILL BE ACCURATE OR RELIABLE, (iv) THE QUALITY OF ANY PRODUCTS, SERVICES, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED BY YOU THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS, AND (v) ANY ERRORS IN THE SOFTWARE WILL BE CORRECTED IN AN EXPEDIENT MANNER.
  5. ANY MATERIAL OR CONTENT SUBMITTED TO FRED'S, DOWNLOADED OR OTHERWISE OBTAINED THROUGH THE USE OF THE SERVICES IS DONE AT YOUR OWN DISCRETION AND RISK AND YOU WILL BE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER SYSTEM OR LOSS OF DATA THAT RESULTS FROM THE SUBMISSION OR DOWNLOAD OF ANY SUCH MATERIAL.
  6. NO ADVICE OR INFORMATION, WHETHER ORAL OR WRITTEN, OBTAINED BY YOU FROM FRED'S OR THROUGH OR FROM THE SERVICES SHALL CREATE ANY PROMISE, REPRESENTATION, WARRANTY, OR RIGHT NOT EXPRESSLY STATED IN THESE TERMS.
  7. A SMALL PERCENTAGE OF USERS MAY EXPERIENCE EPILEPTIC SEIZURES WHEN EXPOSED TO CERTAIN LIGHT PATTERNS OR BACKGROUNDS ON A COMPUTER SCREEN OR WHILE USING THE SERVICES. CERTAIN CONDITIONS MAY INDUCE PREVIOUSLY UNDETECTED EPILEPTIC SYMPTOMS EVEN IN USERS WHO HAVE NO HISTORY OF PRIOR SEIZURES OR EPILEPSY. FRED'S SHALL NOT BEAR ANY RESPONSIBILITY OR LIABILITY FOR SUCH SEIZURES. IF YOU, OR ANYONE IN YOUR FAMILY, HAVE AN EPILEPTIC CONDITION, CONSULT YOUR PHYSICIAN PRIOR TO USING THE SERVICES. IMMEDIATELY DISCONTINUE USE OF THE SERVICES AND CONSULT YOUR PHYSICIAN IF YOU EXPERIENCE ANY OF THE FOLLOWING SYMPTOMS WHILE USING THE SERVICES — DIZZINESS, ALTERED VISION, EYE OR MUSCLE TWITCHES, LOSS OF AWARENESS, DISORIENTATION, ANY INVOLUNTARY MOVEMENT, OR CONVULSIONS.
  8. FRED'S SHALL NOT BE LIABLE TO YOU FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO SPORTS GAMBLING OR WAGERING LOSSES, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA OR OTHER INTANGIBLE LOSSES (EVEN IF FRED'S HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES RESULTING FROM ANY GOODS, DATA, INFORMATION OR SERVICES PURCHASED OR OBTAINED OR MESSAGES RECEIVED OR TRANSACTIONS ENTERED INTO THROUGH OR FROM THE SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES; OR (v) ANY OTHER MATTER RELATING TO THE SERVICES.

13. Special Admonition Related to Sports Wagering

If you intend to use the Services for any purpose related to gambling or wagering money or items of value on the outcome(s) of sports games or contests, you acknowledge that Fred's provides no assurances whatsoever regarding the accuracy or performance capabilities of the Services, especially regarding the effectiveness of information included in the Services as applied to gambling. You acknowledge the significant risk for personal loss that may result from basing wagering decisions on information included in the Services, and you agree that you will not interpret information provided by the Services as a recommendation or encouragement by us for you to gamble or take part in any unlawful activities.

14. Indemnity

You agree to indemnify, defend, and hold Fred's, and its subsidiaries, affiliates, officers, agents, directors, co-branders or other partners, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of the use of the Services, your connection to the Services, your violation of these Terms, or your violation of any rights of another.

15. Age Eligibility; Registration; "Purchasers"

To access, download, or otherwise use any Fred's content, including the Playbook or any Guide, or to become a paying Purchaser ("Purchaser") of the Services, you must be at least 21 years of age (or any higher age required by the User's jurisdiction). To become a Purchaser, you must also be of legal age to form a binding contract and not a person barred from receiving Services under the laws of the United States or other applicable jurisdiction. Minors are prohibited from using the Services in any capacity, and we reserve the right to refuse Services to anyone for any reason at any time.

16. Account Information

You represent and warrant that the information that you provide to us upon registration and at any other time ("User Information") is true, accurate, current, and complete. You also agree to keep your User Information accurate and up to date at all times. This is especially important with respect to your email address, since email is the primary method by which we will communicate with you about your account and your subscription purchases. If you provide any information that is untrue, inaccurate, not current or incomplete, or if we have a reason to suspect that such information is untrue, inaccurate, not current or incomplete, then we maintain the right to suspend or terminate your account.

17. Password

You may be asked to provide a password for your account. As you will be responsible for all activities that occur under your password, you should keep your password confidential. You agree to notify Fred's immediately of any known or suspected unauthorized use of your password or if you believe that your password is no longer confidential. We reserve the right to require you to alter your password if we believe that your password is no longer secure.

You also agree not to willingly share your Fred's password with any other person. Willingly sharing your Fred's password is a violation of these Terms and grounds for termination of your access to the Services, without refund.

18. Formation of a Binding Contract

No contract for Services exists between you and Fred's for the transfer of any paid Services until Fred's receives and accepts the order via a confirmatory e-mail or other appropriate means of communication from you.

19. Communications

You understand that the Services include periodic communications from Fred's, and you agree to be automatically enrolled to receive these communications, including email newsletters. Every email newsletter we send you will provide a means to unsubscribe if you no longer wish to receive email newsletters, and you are free to unsubscribe at any time.

By voluntarily providing any personally identifiable information to Fred's in the process of purchasing one of Fred's products or services, Purchaser agrees and gives permission to Fred's to contact Purchaser by means of telephone or e-mail or other communications method for purposes related to Purchaser's account or services. Fred's commits to comply with applicable federal and state laws governing telephone and email communications, including the Telephone Consumer Protection Act (TCPA) and the CAN-SPAM Act.

20. Rights for Submitted Content

By using the Services, you grant Fred's a non-exclusive, perpetual, royalty-free, transferable license to use, share, copy, distribute, and display any original information or digital content that you submit or upload to the Services. These rights will be restricted accordingly in any case where the Services offer you privacy controls to restrict the sharing or distribution of content you submit or upload.

21. Monitoring of Content

Fred's does not control the content of members' accounts and does not have any obligation to monitor such content for any purpose. You acknowledge that you are solely responsible for all content and activity that occurs on your user account.

22. General Information

You acknowledge, consent and agree that Fred's may access, preserve, and disclose your account information if required to do so by law or in a good faith belief that such access, preservation, or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms; (c) respond to your requests for customer service; or (d) protect the rights, property, or personal safety of Fred's, its users, and the public.

You understand that the technical processing and transmission of the Services may involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. You understand that the Services and software embodied within the Services may include security components that permit digital materials to be protected, and use of these materials is subject to usage rules set by Fred's and/or content providers who provide content to the Services. You may not attempt to override or circumvent any of the usage rules embedded into the Services.

These Terms constitute the entire agreement between you and Fred's and govern your use of the Services, superseding any prior agreements between you and Fred's with respect to the Services. You also may be subject to additional terms and conditions that apply when you use or purchase other Fred's Services, affiliate Services, third-party content or third-party software.

The failure of Fred's to exercise or enforce any right or provision of these Terms does not constitute a waiver of such right or provision. If any court finds that one or more rights or provisions contained in these Terms is invalid, you agree that the remainder of these Terms shall be enforceable.

You agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the Services or these Terms must be filed within one (1) year of the event giving rise to such claim or cause of action, or such claim or cause of action will be forever barred.

You agree that, except as otherwise expressly provided in these Terms, there are no third-party beneficiaries to this agreement.

23. Suspension, Modification and Termination of Access and Membership

You agree that, at any time, without notice, Fred's may:

  1. Refuse to accept your application to become a Purchaser of the Services;
  2. Move or suspend any part of the Services;
  3. Restrict your access to all or certain parts of the Services if you do not pay all applicable fees to Fred's when required;
  4. Modify any username or other content that could be confused with any Fred's features, products or Services or which contains any explicit/objectionable content;
  5. Refuse to fulfill any order or any part of any order or terminate your account and delete any content stored in your account if, in our sole discretion, you fail to comply with any of these Terms or if a competent regulatory authority requires us to do so.

Any violation of these Terms gives us the right to terminate your account without refund for any prepaid fees.

You may cancel your Fred's account or subscription at any time, without refund for any prepaid fees, by sending a cancellation request via email to fred@fredsteaserpicks.com or by using the appropriate cancellation functionality provided within the Services.

Your subscription to the Weekly Picks is sold for the 2026-27 NFL regular season only and does not automatically renew. Your subscription will end at the conclusion of the 2026-27 NFL regular season for which you have already paid. Before any future season, Fred's will invite you to affirmatively opt in if you wish to purchase a subscription for that season. You will not be enrolled, and no fee will be charged, for any future season unless you take that affirmative step.

24. Governing Law; FAA

These Terms and any dispute, claim, or controversy arising out of or relating to the Services, these Terms, or Fred's relationship with you (each, a "Dispute") will be governed by the Federal Arbitration Act with respect to the enforceability and interpretation of this arbitration provision. For all other issues, the arbitrator will apply the substantive laws of the State of Florida, without regard to Florida conflict-of-laws rules.

25. Agreement to Arbitrate; AAA Consumer Rules

Any Dispute will be resolved by final and binding arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is filed (the "AAA Rules"), as modified by these Terms. Judgment on the award may be entered in any court of competent jurisdiction.

26. Location; Hearing Format

The arbitration will be conducted in Miami, Florida, unless otherwise agreed or the AAA Rules permit a remote hearing. The arbitrator may decide motions and conduct hearings by video, telephone, or written submissions to the extent permitted by the AAA Rules.

27. Class Action Waiver; Individual Proceedings Only

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YOU AND FRED'S BOTH AGREE TO WAIVE THE RIGHT TO BRING ANY ACTION AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING.

The arbitrator may award relief only in favor of the party seeking relief and only to the extent necessary to resolve that party's claim. The arbitrator has no authority to conduct any class, collective, consolidated, or representative arbitration.

28. Delegation (Arbitrability)

Except as provided in Section 27 (Class Action Waiver), the arbitrator will have exclusive authority to resolve any dispute about the interpretation, applicability, enforceability, or formation of this arbitration provision, including any claim that all or part of it is void or voidable.

29. Arbitration Fees and Costs

In the event of arbitration, you and Fred's will pay arbitration fees and costs as required by the AAA Rules and applicable law. The arbitrator may award attorneys' fees and costs only where authorized by applicable law.

30. Remedies; Limitation of Liability

To the maximum extent permitted by law, for contract-based claims (including breach of contract), Fred's total aggregate liability arising out of or relating to the Services or these Terms will not exceed the amount actually paid by the Purchaser for the specific Services giving rise to the Dispute, and the Purchaser's exclusive remedy for such claims will be a refund of that amount.

This limitation does not apply to, and does not limit, any remedies that cannot be waived or limited under applicable law, including any statutory rights or remedies that, as a matter of law, may not be limited by contract.

31. Jury Trial Waiver

IF A DISPUTE IS NOT SUBJECT TO ARBITRATION, THE PARTIES WAIVE ANY RIGHT TO A JURY TRIAL TO THE MAXIMUM EXTENT PERMITTED BY LAW.

32. Termination

You agree that Fred's may, without prior notice, terminate your account and/or your access to some or all parts of the Services for cause. Cause for such termination shall include, but not be limited to:

  1. Breaches or violations of these Terms or other incorporated agreements or guidelines;
  2. Requests by law enforcement or other government agencies;
  3. A request by you (self-initiated account deletions);
  4. Discontinuance or material modification to the Services (or any part thereof);
  5. Unexpected technical or security issues or problems;
  6. Any fraudulent or illegal activities; and/or
  7. Nonpayment of any fees owed by you in connection with fee-based parts of the Services.

Termination of the Services may include deletion of your email address, username, password, and any other information stored in or associated with your account and barring you from future use of the Services.

33. Refund Policy

All sales are final, except that there is a 3-day window from the purchase date for purchasers of the Weekly Picks during which the purchaser may request and receive a full refund. Fred's does not issue any other refunds unless there are operational problems on Fred's side that prevent us from delivering the Services to you. Any refund for operational problems on Fred's side shall be proportional. For instance, if Fred's fails to provide weekly picks for one weekend of the 18-week NFL season, Fred's will refund eligible Purchasers 1/18th of the purchase price of the weekly picks.

34. Inactivity Policy

If your account becomes inactive for a period of at least 12 months, Fred's may, at its sole discretion, terminate access to your account altogether, including deletion of any account information held by Fred's. Fred's may change this policy at any time by updating these Terms and making them available to you.

35. Headings

All headings are for convenience purposes only and have no bearing on the effect of any provision of these Terms.
